PLEASE READ CAREFULLY THESE TERMS AND CONDITIONS AND THE FAQs BEFORE REGISTERING FOR YOURSELF IN MODEL GALAXIES. IF YOU PROCEED INDICATES THAT YOU ACCEPT THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, PLEASE DO NOT REGISTER.

1. General

1.1 Nothing in this Agreement will be deemed to create an employment, partnership or joint venture between You and Model Galaxies.

1.2 No failure or delay by Model Galaxies in exercising its rights under this Agreement will operate as a waiver of that right nor will any single or partial exercise of any right preclude any further exercise of that right.

1.3 The rights and remedies under this Agreement are cumulative and in addition to any rights and remedies provided by law.

1.4 This Agreement and the documents referred to in it contain the entire agreement between You and Model Galaxies relating to its subject matter and save in respect of any fraudulent misstatement supersede all prior representations, agreements, arrangements or understandings relating to such subject matter between the parties, whether written or oral. You and Model Galaxies acknowledge that we are not relying on any representation, agreement other than the agreements referred to in this Agreement, term or condition that is not set out in this Agreement.

1.5 If any provision or part of this Agreement is held to be invalid, amendments to this Agreement may be made by the addition or deletion of wording as appropriate to remove the invalid part or provision but otherwise retain the provision and the other provisions of this Agreement to the maximum extent permissible under applicable law.

1.6 Model Galaxies reserves the right to assign or otherwise transfer any rights or obligations under this Agreement. You are not entitled to assign or otherwise transfer any rights or obligations under this Agreement without the prior written consent of Model Galaxies.

1.7 Model Galaxies shall be under no liability for any failure, delay or omission on its part if the same arises from any cause beyond Early Warning's control including, but not limited to, Acts of God, acts or regulations of government or other authorities, war, fire, strikes or other industrial disputes, power failure, failure of telecommunication lines connections or equipment, of failure or defects in any hardware or software owned or supplied by third parties.

1.8 This Agreement shall be governed by and construed in accordance with the laws of Malaysia and the parties submit to the exclusive jurisdiction of the Malaysian courts as regards any claim or matter arising in relation to this Agreement.

2. Termination/ Cancellation of Assignment

2.1 In the event You are unable to attend the job assigned, prior notice of 48 hours before the job starts, must be given to Model Galaxies and the recruiter.

2.2 A valid reason must also be given on notification. You will be excused if the Model Galaxies and the recruiter accept your reason given.

2.3 If You fail to notify and provide a valid reason for your late, absence or cancellation, You will be blacklisted in Model Galaxies and Model Galaxies reserves the right not to arrange any further jobs for You.

2.4 In the event the recruiter prematurely terminates the assignment before the job ends due to your fault (eg: You are late, do not attend the job without any valid reason and sufficient notice, your misconduct), You are only entitled to 50% of the payment for all your service.

3. Disclaimer

3.1 MODEL GALAXIES is a talents referral service only and shall not responsible for the services provided by the talents. Each talents is solely responsible in offering his services, paying all taxes on income earned, and all other issues and responsibilities related to his job.

3.2 MODEL GALAXIES will not act as an arbitrator or mediator for any conflicts or disagreements that arise between the talents and the recruiter. However, Model Galaxies are always prepared to offer our views and suggestions.

3.3 MODEL GALAXIES reserves the right to add, modify or delete any information on this website at any time without notice. Model Galaxies reserves the right, at its sole discretion, to terminate Your use of the Website at any time for any reasons.

3.4 You are solely responsible for the information You provide to MODEL GALAXIES. MODEL GALAXIES is not liable to any misrepresentation, fraud, or any attempt to misrepresentation, fraud, or inaccuracies of information provided by You.

3.5 The entire risk as to the quality, accuracy, adequacy, completeness, correctness and validity of any material rests with You. To the fullest extent permissible pursuant to applicable law, MODEL GALAXIES, its affiliates, and their respective officers, directors, employees, agents, licensors, and representatives, will not be liable for damages of any kind including, without limitation, compensatory, consequential, incidental, indirect, special or similar damages, that may result from the use of, or the inability to use, the materials contained on this site whether the material is provided or otherwise supplied by You.

3.6 Model Galaxies does not involve in any talents-recruiter or talents-customer interactions. Model Galaxies is not responsible for any disputes, claims, loss, injury, or damage that might arise during and after the job and the interaction. Work and interact with the recruiter and customer at your own risk.

3.7 Model Galaxies shall not be held liable in the event of any default of payment by recruiter. You are not entitled to sue and claim from Model Galaxies for any default of payment by recruiter. Instead, You shall sue and claim from the recruiter directly for any default of payment.

3.8 You promise not to sue Model Galaxies and hereby waive any and all claims against Model Galaxies from any liability arising out of or related to the acts or omissions of the recruiter or any other third parties. You agree to defend, indemnify, and hold harmless Model Galaxies, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your breach of these Terms of Use, or use of the Material or User Content.

3.9 The Website may contain links to third party websites as a convenience. Model Galaxies is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If You decide to access linked third party Web sites, You do so at Your own risk.

4. Trademark Information

MODEL GALAXIES is a protected unregistered trademark. All other trademarks displayed on this site or through links to other sites are the property of the respective trademark owners.
